Construction Defect Litigation

Oklahoma's heavy clay soil is prone to severe contraction and expansion, causing walls and floors to crack, or even bringing the whole structure down. Inferior materials or shoddy construction also allow moisture to infiltrate the interior of the home. Shelton Voorhees Law Group consults with geotechnical engineers, products engineers, structural engineers, and other experts to prove (or disprove) liability for the damage.

Legal Remedies: Under the Right to Repair Law, homeowners are protected but builders have an opportunity to correct the problem and still get paid. If the damage is not repairable or the contractor balks, we help owners sue for monetary damages and/or to sell the building back. Many builders and developers aim to deflect construction defect litigation through one-year warranties in the construction contract. However, these warranties are not dispositive. Depending on when they were first aware of the problems, plaintiffs may still be able to bring a suit in District Court for general negligence.
